By accessing or using RetroTagr, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

RetroTagr is a photo geotagging service that allows you to add GPS coordinates to your photos. We provide tools to embed location metadata into your photo files.

3. User Accounts

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

Photos are stored according to your subscription tier. We reserve the right to delete photos that exceed retention periods or storage limits.

6. Payment and Billing

6.1 Billing

Paid subscriptions are billed monthly through Stripe. You authorize us to charge your payment method for the subscription fee. If you exceed your monthly photo limit, overage charges will be applied to your next billing cycle at the rate specified for your tier.

6.2 Refund Policy

All subscription fees are non-refundable. We encourage you to use our free tier to evaluate the service before subscribing to a paid plan. If you believe you have been incorrectly charged or experience a documented service failure, please contact us at legal@retrotagr.com within 30 days of the charge. We will review billing disputes on a case-by-case basis for documented technical issues that prevented service use.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or by contacting us at legal@retrotagr.com. Upon cancellation, you will retain access to your paid features until the end of your current billing period. No partial refunds will be provided for unused time. After cancellation, your account will be downgraded to the free tier, and photos exceeding free tier limits may be subject to deletion according to our retention policies.

You agree not to:

• Upload illegal, harmful, or offensive content
• Violate any applicable laws or regulations
• Attempt to circumvent usage limits or security measures
• Use the service for any unauthorized commercial purposes
• Interfere with or disrupt the service

8. Intellectual Property

You retain ownership of your photos. By using our service, you grant us a limited license to process, store, and transmit your photos as necessary to provide the service.

9. Disclaimers and Warranties

The service is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Indemnification

You agree to indemnify and hold harmless RetroTagr from any claims, damages, or expenses arising from your use of the service or violation of these terms.

12. Termination

We may suspend or terminate your account at any time for violation of these terms. Upon termination, your right to use the service will cease immediately.

13. Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.

14. Governing Law

These terms are governed by the laws of Germany. Any disputes shall be resolved in the courts of Germany.

15. Artificial Intelligence Disclosure

RetroTagr uses artificial intelligence (AI) to provide optional location and date suggestions for your photos. This section explains how AI is used in compliance with the EU AI Act 2025.

15.1 AI Providers

We use the following third-party AI services to analyze photos and provide suggestions: Google Cloud Vision API for landmark detection and location identification; Anthropic Claude for date estimation and contextual analysis; Google Gemini for supplementary analysis. Your photos may be processed by these providers when you use AI-powered features.

15.2 How AI Is Used

AI is used exclusively for providing suggestions, not automated decisions:

• Location Suggestions: AI analyzes visual elements (landmarks, signs, architecture) to suggest possible GPS coordinates
• Date Estimation: AI examines visual cues (fashion, vehicles, technology) to estimate when a photo was taken
• Text Extraction: AI identifies and extracts readable text visible in photos
• All AI outputs are suggestions that you can accept, reject, or modify

15.3 Your Control

AI features are optional and require your explicit action to use. AI suggestions are never automatically applied to your photos. You maintain full control over whether to accept, modify, or reject any AI-generated suggestion. Confidence scores are displayed to help you evaluate the reliability of suggestions.

15.4 Data Processing

When you use AI features, your photos are temporarily transmitted to our AI providers for analysis. Photos are processed in accordance with our Privacy Policy and are not retained by AI providers beyond the analysis session. You can use RetroTagr without AI features by manually entering location data.
